SEMBARA HOTELS & APARTMENTS S.L. is the owner of all copyright, intellectual and industrial property rights, “know how” and any other rights related to the contents of the website www.hostaltoloxsierradelasnieves.com and the services offered therein, as well as the programmes necessary for its implementation and related information.

Intellectual property of the software

These rights are valid only for the duration of the contract.

For any action beyond the fulfilment of the contract, the user must obtain written authorisation from SEMBARA HOTELS & APARTMENTS S.L..

The user is strictly prohibited from accessing, modifying, or viewing the configuration, structure, and files of the servers owned by the company.

The user assumes full civil and criminal liability for any incident that may occur in the servers or security systems.
This applies when the incident is a direct result of negligent or malicious action on their part.

Intellectual property of the hosted contents

The use contrary to the legislation on intellectual property of the services provided by SEMBARA HOTELS & APARTMENTS S.L. and, in particular:

  1. The use that is contrary to Spanish law or that infringes the rights of third parties.
  2. The publication or transmission of any content which, in the opinion of SEMBARA HOTELS & APARTMENTS S.L., is violent, obscene, obscene, obscene, obscene, obscene or obscene. is violent, obscene, abusive, illegal, racial, xenophobic or defamatory.

In line with current laws and regulations, the user must also comply with the rules governing online services, e-commerce, copyright, maintenance of public order, and universal principles of Internet use.

Whenever SEMBARA HOTELS & APARTMENTS S.L. is held responsible for an incident attributable to the user, the company shall be indemnified for all related expenses. This covers legal defence costs and other fees, even when the court decision is not final.

Protection of hosted information

SEMBARA HOTELS & APARTMENTS S.L. makes backup copies of the contents hosted on its servers, however it is not responsible for the loss or accidental deletion of data by users. 

Likewise, it does not guarantee the total replacement of data deleted by users, as the aforementioned data may have been deleted and/or modified during the period of time elapsed since the last backup.

The services offered, except for specific backup services, do not include the replacement of the contents of the backup copies made by SEMBARA HOTELS & APARTMENTS S.L. in cases where this loss is attributable to the user; in this case, a fee will be determined according to the complexity and volume of the recovery, always with the prior acceptance of the user.

The replacement of deleted data is only included in the price of the service when the loss of content is due to causes attributable to SEMBARA HOTELS & APARTMENTS S.L. 

Commercial communications

In application of the LSSI. SEMBARA HOTELS & APARTMENTS S.L. will not send advertising or promotional communications by e-mail or other equivalent means of electronic communication that have not been previously requested or expressly authorised by the recipients of the same.

In the case of users with whom there is a previous contractual relationship, SEMBARA HOTELS & APARTMENTS S.L. is authorised to send commercial communications regarding products or services of SEMBARA HOTELS & APARTMENTS S.L. that are similar to those that were initially contracted with the client.

In any case, the user, after proving his/her identity, may request that no further commercial information be sent to him/her through the Customer Service channels.
